1. Introduction

Welcome to Evim. These Terms and Conditions govern your access to and use of the Evim platform, including all related services, applications, and tools (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms.

2. Service Description

Evim provides a real estate customer relationship management platform designed for buyer’s agents and their clients. The Platform facilitates property search, client management, property sharing, visit scheduling, and communication between agents and clients.

3. User Obligations

By using the Platform, you agree to:

• Provide accurate, complete, and up-to-date information
• Use the Platform only for lawful purposes related to real estate activities
• Keep your account credentials secure and confidential
• Not attempt to access other users’ data without authorization
• Not use the Platform for any fraudulent, misleading, or illegal activity
• Comply with all applicable laws and regulations in Spain

4. Data Protection and Privacy

We are committed to protecting your personal data in accordance with the General Data Protection Regulation (EU) 2016/679 (GDPR) and the Spanish Organic Law 3/2018 on Data Protection and Digital Rights (LOPDGDD).

• Data Controller: Evim is the data controller responsible for processing your personal data.
• Data Collected: We collect and process personal information you provide, including name, email address, phone number, property preferences, financial status indicators, and location preferences.
• Purpose: Your data is processed to provide real estate CRM services, facilitate communication between agents and clients, and improve the Platform experience.
• Legal Basis: Processing is based on your consent (by accepting these Terms), the performance of a contract, and our legitimate interests in providing the service.
• Data Retention: Personal data is retained for the duration of your account and for a reasonable period thereafter as required by law or for legitimate business purposes.
• Your Rights: You have the right to access, rectify, erase, restrict processing, data portability, and object to processing of your personal data. To exercise these rights, contact us at privacy@evim.io.
• Data Transfers: Your data may be processed using cloud infrastructure. We ensure appropriate safeguards are in place for any international data transfers.

5. Cookies and Tracking

The Platform uses essential cookies to maintain your session and provide core functionality. We use portal access tokens stored in cookies for secure, passwordless client access.

6. Intellectual Property

All content, designs, logos, and software on the Platform are the intellectual property of Evim or its licensors. You may not copy, modify, distribute, or create derivative works from any Platform content without prior written consent.

7. Property Listings

Property information displayed on the Platform is provided for informational purposes only. Evim does not guarantee the accuracy, completeness, or availability of any property listing. Users should independently verify all property information before making any decisions.

8. Limitation of Liability

To the maximum extent permitted by law, Evim shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Evim does not act as a real estate agency and is not responsible for the outcome of any real estate transactions facilitated through the Platform.

9. Account Termination

Evim reserves the right to suspend or terminate your account at any time for violation of these Terms. You may request account deletion at any time by contacting us. Upon termination, your data will be handled in accordance with our data retention policies and applicable law.

10. Modifications

Evim reserves the right to modify these Terms at any time. Updated Terms will be presented to you upon your next access to the Platform. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Spain. Any disputes arising from or relating to these Terms shall be submitted to the courts of Barcelona, Spain, unless otherwise required by applicable consumer protection laws.
